TeacherTeacher Terms of Use
Last updated: October 25, 2026. These Terms apply to TeacherTeacher Cam and to the website teacherteacher.xyz. Our Privacy Policy and Refund Policy are part of them.
PART A. TERMS OF USE
1. The agreement
1.1 These Terms of Use (the "Terms") are an agreement between you and TeacherTeacher LLC, a New Mexico limited liability company (New Mexico Business ID 0008138074) with its address at 1209 Mountain Road Pl NE, Ste R #13550, Albuquerque, NM 87110 ("we", "us", "TeacherTeacher"). They cover the TeacherTeacher Cam program, the website at teacherteacher.xyz, and the props, backgrounds, tools, features and updates we provide (together, the "Cam").
1.2 The Terms include Parts B to F, our Privacy Policy (teacherteacher.xyz/privacy.html) and our Refund Policy (teacherteacher.xyz/refunds.html), and any plan or product page you accept when you buy (together, the "Agreement"). If a plan page and these Terms conflict about that plan, the plan page controls for that plan.
1.3 You accept the Agreement by clicking "I agree" when you install the Cam, create an account or buy a plan, or by using the Cam after we tell you it applies. If you do not agree, do not install or use the Cam.
1.4 Please read Part E (dispute resolution) carefully. It affects your rights.
2. Who may use the Cam
2.1 The Cam is made for teachers and other adults who present or teach by video. You must be at least 18 years old, or the age of majority where you live, to accept the Agreement. Students are not users of the Cam.
2.2 If you accept for a school or business, you confirm that you have authority to bind it, and "you" includes it. A person who accepts for a school remains responsible for how the Cam is used on that school's behalf.
2.3 You must not use the Cam if the law prevents us from supplying it to you, including under export and sanctions laws (section 20).
3. Your licence
3.1 We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Cam, for your own teaching and presenting, on the number of computers your plan allows: one for the free edition, and one, three or five registered computers for the paid plans.
3.2 The Cam is licensed, not sold. We and our licensors keep all rights not expressly granted. Some parts of the Cam are third-party software provided under their own licences, listed in the program's notices. Those owners may enforce their rights directly.
3.3 You may not, and may not help anyone to: (a) copy, sell, rent, lease, sublicense or distribute the Cam, or make it available to others; (b) reverse engineer, decompile or try to extract source code, models or the sample pictures, except where the law gives you that right and only to the extent it does; (c) remove or alter notices, watermarks or licence checks, or bypass any limit or plan feature (anti-circumvention); (d) use or share a licence on more computers or by more people than your plan allows; (e) use the Cam, or what you learn from it, to build or improve a competing product or service; (f) publish performance comparisons or test results about the Cam made without our written consent, where the law allows us to ask this; (g) use automated means to extract content from the Cam or the website.
3.4 We may change, limit or end the free edition and any beta preview, as set out in section 7.
4. Computers, accounts and licence checks
4.1 A registered computer is one computer on which a licence is activated. To move a licence you release the old computer from your account page and activate the new one. When all registered computers are in use, a new installation opens in the free edition until one is released.
4.2 Where the Cam uses accounts or licence keys, you are responsible for your account, your password and what happens under it. Keep your sign-in details to yourself and tell us promptly if you think someone else has used them.
4.3 The Cam may contact our licence service to confirm your plan. If it cannot do so, paid features keep working for 14 days after the last successful check, after which the Cam may return to the free edition until a check succeeds. What a licence check sends is described in the Privacy Policy.
5. Your content
5.1 You keep ownership of the props, pictures, backgrounds, recordings, settings and other material that you create, add or save with the Cam ("Your Content"). It is stored on your computer. We do not intentionally upload or store copies of it (see Part G), and we claim no ownership of it and no licence to it, except as section 5.4 describes. If you keep Your Content in a folder that a cloud service synchronizes, that service, not us, handles the copies.
5.2 You are responsible for Your Content and for how you use it. Before you add or use something, check that you own it or have permission for it, including photographs, characters, logos, artwork, music, other people's faces and names, and any material that belongs to your school. We do not review, edit or monitor Your Content.
5.3 You are responsible for any notice, consent or permission needed by law or by your school before you show, record or share a picture of a student or any other person, including children. The Cam does not send the picture it shows to us; what a class app or recording does with it is outside our control.
5.4 If you send us feedback, a support request, a log or an image, you give us a non-exclusive, worldwide, royalty-free, perpetual licence to use what you send to answer you, run and improve the Cam and keep our records. Do not send material you are not allowed to share. We may use feedback and ideas without owing you anything. We will not publish your name or your pictures without your permission.
6. Our samples, pictures and branding
See Part D.
7. Free edition, beta preview and changes
7.1 We offer the free edition indefinitely. "Indefinitely" means it continues without a set end date, but it can be changed or ended at any time with proper notice. We do not anticipate reducing the free edition after the first public release.
7.2 What you buy is the TeacherTeacher Cam virtual camera and the camera features listed for your plan. Teaching tools and other sample features are not part of your purchase. Each plan includes a beta preview of sample features and products before their full release, and higher plans include more. Beta preview items are provided as is, may contain errors, and may be added, changed, limited or removed according to teacher feedback or as management chooses.
7.3 Tools still in development are listed under "In development". We do not anticipate release dates, and we make no promise that any of them will be released.
7.4 We may update the Cam, including to fix errors, address security, comply with law or improve the product. Updates install over the earlier version and do not remove your saved files or settings. We may stop supporting an older version or an older operating system after reasonable notice. Windows 10 is supported on the terms stated on our site.
7.5 What your subscription pays for, and the complimentary Pro Library.
(a) What you pay for. A Pro subscription pays for access, during your paid term and on the number of computers in your plan, to the Pro edition of the Cam, which builds on the free edition: the Pro tools as listed for your plan when you subscribe (for example no watermark on your picture, the green screen after the grand-opening period, Look better, the creation tools, and unlimited use of your own pictures) and access to the Pro Library. You are not paying for any individual background, prop, face filter, avatar, emoji, bobblehead or other library item, and no individual item is the subject of the sale.
(b) The library items are complimentary. The items shown in the Pro Library (and the starter items in the free edition) are included at no extra charge as a complimentary part of the service. They are not sold, priced or licensed to you one by one.
(c) We may change them. We choose the library items at our discretion and may add, change, replace, rotate or retire any of them at any time, with or without notice. You acquire no ownership of, or lasting right to, any particular item, and we do not promise any number, variety or permanence of items. A change to the items does not give rise to a refund, credit or price change. When an item is retired, it also stops appearing in any saved look that used it.
(d) Backgrounds too. This applies in the same way to backgrounds, props, face filters, avatars, emoji, bobbleheads and every other library item.
(e) Not covered by this section: specialty bundles and packs you buy separately (they are purchases, and Part B9 applies); your own pictures and creations (what you upload or make is yours and stays on your computer); and the Pro tools: if we remove a Pro tool listed for your plan, or reduce it materially, we will tell you before it takes effect, and you may then cancel and receive a refund for the unused part of your paid term.
(f) Our aim. We intend to keep the Pro Library generous and growing, and when we retire items we usually replace them with comparable or better ones. This is a statement of intent, not a promise about any item.
(g) Your legal rights. Nothing in this section limits any right you have under the law where you live that cannot be excluded or limited by contract.
7.5 We may change prices and plan contents for future terms. A change to a paid plan applies at the next renewal, after notice (section B6).
8. Third-party software, class apps and compatibility
8.1 The Cam works alongside operating systems, camera drivers and class apps made by others. We do not control them, and we cannot promise that the Cam will work with every computer, camera or app, or continue to work when they change. Compatibility with a class app does not mean that the app's maker endorses or supports the Cam, and we are not connected with them.
8.2 Third-party names mentioned by you, or in the program for compatibility, belong to their owners.
8.3 Some optional features or third-party components may process information as described in the Privacy Notice.
9. Educational, professional and safety use
9.1 The Cam, the Report and Sentence Generator and any translation or writing aid are tools that support your professional judgment. They are not a substitute for it. They may contain errors, omit context or use wording that is unsuitable for a dialect or a student. Review all output before you use or share it.
9.2 Do not rely on the Cam where a failure could cause harm, including emergencies, safety-critical or life-critical situations, or while driving or operating machinery.
9.3 Nothing from us is legal, tax, financial, medical or educational-compliance advice.
9.4 Educational tool only. The Cam, its pictures, props, backgrounds, face filters, avatars and emoji, and the Report and Sentence Generator are an educational tool for teachers, ESL schools and their students. They are not meant for any other purpose. We cannot control how anyone else uses or misuses them. Any use other than for education is not authorized and is not endorsed by us.
9.5 No endorsement. Nothing we offer endorses or promotes any ideology, political party or affiliation, candidate, religion, cause or organization. A person, flag, symbol, holiday, country or historical figure appears only as a teaching aid. Our choices of pictures, names and gifts do not show support for any group. Holiday items may show figures, scenes and symbols that have a religious meaning for the people who celebrate the holiday; they are shown only as teaching aids, with respect, and do not mean that we believe in, endorse, promote or demote any religion or belief; we simply let everyone embrace what they cherish.
10. Warranty disclaimer
To the fullest extent the law allows, the Cam and everything that comes with it are provided "as is" and "as available", without any promise, express or implied, including of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy or that it will work without interruption or errors, or on your equipment. Some places do not allow some of these disclaimers, and then they apply only as far as the law permits. Rights that cannot be excluded by law are not affected (Part F).
11. Limits on our responsibility
11.1 To the fullest extent the law allows, we and our officers, members, contractors, suppliers and licensors are not responsible for indirect, incidental, special, consequential, exemplary or punitive losses, or for lost classes, lost income, lost profits, lost data or loss of goodwill, even if we were told they might happen.
11.2 To the fullest extent the law allows, our total responsibility to you for all claims about the Cam is limited to the greater of (a) what you paid us for the Cam in the 12 months before the event that gave rise to the claim, and (b) US$50. For free use, it is US$50.
11.3 Nothing in the Agreement limits or excludes responsibility that the law does not allow to be limited or excluded, including for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, for intentional or grossly negligent misconduct where the law prohibits a limit, or the statutory rights of consumers (Part F).
11.4 We are not responsible for third-party software, class apps, camera drivers, networks or your computer, or for events beyond our reasonable control (section 18).
11.5 The limits in this section 11 apply whatever the legal theory (contract, tort, statute or other) and are a reasonable allocation of risk reflected in the price, including the free edition's price of zero.
12. Indemnity
12.1 You will defend us against, and reimburse our reasonable losses and costs (including reasonable attorneys' fees) from, a claim by a third party that arises from (a) Your Content, (b) your breach of the Agreement or of the law, or (c) your use of the Cam to record, show or share a person's image or information without a permission the law requires.
12.2 We will tell you promptly of the claim, let you control the defense (we may take part at our own cost), and cooperate at your cost. You may not settle a claim in a way that admits fault by us or imposes obligations on us without our consent.
12.3 This section 12 does not apply to consumers where the law does not allow it, and applies to a school or business to the extent the law allows.
13. Suspension and ending
13.1 You may stop using the Cam at any time by uninstalling it. You may cancel a subscription as set out in Part B.
13.2 We may suspend or end your licence, with notice where practical, if you materially breach the Agreement, if we reasonably believe your use is unlawful or harms others or the Cam, if you do not pay, or if we stop offering the Cam. If we end a paid licence for reasons other than your breach, we will refund the unused part of the paid term.
13.3 On ending, your licence stops, paid features may stop working, and you must stop using the Cam. Your local files stay on your computer. Cancelling or allowing a subscription to expire does not itself delete your local files.
13.4 Sections that by their nature continue after the Agreement ends do so, including sections 3.3, 5, 6, 10, 11, 12, 15, 16, 19 and Parts D, E and F.
14. Changes to the Agreement
14.1 We may change the Agreement. We will post the new version with its date and tell you in the Cam or by email when a change matters, at least 30 days before it applies to paid plans where the change is not required by law.
14.2 If you do not accept a change that is adverse to you, you may stop using the Cam, and if you have a paid plan you may cancel and receive a refund for the unused part of the paid term. Using the Cam after the change takes effect means you accept it.
15. Notices and electronic records
15.1 We may give notice by email to the address on your account or by posting it in the Cam or on the website. You may give notice to info@teacherteacher.xyz, with a copy by post to TeacherTeacher LLC, 1209 Mountain Road Pl NE, Ste R #13550, Albuquerque, NM 87110, USA for legal notices.
15.2 You agree to do business with us electronically, and you agree that our electronic records of your acceptance, purchase, licence and use are valid evidence.
16. General terms
16.1 Entire agreement. The Agreement is the whole agreement between you and us about the Cam and replaces earlier understandings about it.
16.2 Severability. If a part is found unenforceable, it is limited or removed as far as needed and the rest continues.
16.3 No waiver. A failure or delay in enforcing a right is not a waiver of it.
16.4 Assignment. You may not assign or transfer your rights or duties without our written consent. We may assign the Agreement to an affiliate or to a buyer or successor of our business, and will tell you, and your rights under the law are not reduced by an assignment.
16.5 No third-party rights. Except for the owners of third-party software (section 3.2) and the persons protected by sections 11 and 12, no one else has rights under the Agreement.
16.6 Relationship. We are independent contractors to each other. Nothing creates a partnership, employment or agency.
16.7 Language. The Agreement is written in English, and the English version controls where we provide a translation.
16.8 Headings and interpretation. Headings are for convenience. "Including" means "including without limitation".
16.9 Order of precedence. If documents conflict: a signed written agreement with us, then the plan or product page for that plan, then Parts B to F, then these Terms, then the Privacy Notice for personal information.
16.10 Security and vulnerability reports. If you find a security problem, tell us at info@teacherteacher.xyz and give us reasonable time to fix it before you disclose it. We will not take action against good-faith research that follows this rule and the law.
17. Marketing contact
We will send you service messages (receipts, security, changes to the Agreement). We will send marketing email only if you opt in, and every marketing email will include a way to stop.
18. Events beyond our control
We are not in breach of the Agreement, and are not responsible, for a failure or delay caused by an event beyond our reasonable control, including natural disaster, war, terrorism, civil unrest, strike, labor dispute, power or internet failure, cyberattack, failure of a third-party platform, payment provider or operating system, government action, pandemic, or change in law. This does not excuse a payment you owe or reduce a refund you are due by law.
19. Governing law
Subject to Part F, the Agreement and any dispute about it are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
20. Export, sanctions and compliance
You confirm that you are not located in, and will not use or send the Cam to, a country or region under comprehensive United States sanctions or embargo, are not on a United States government list of restricted parties, and will not use the Cam for a use the law prohibits. You are responsible for any local law on your use of the Cam, including laws about recording, privacy, and online conduct.
21. Taxes
Prices exclude taxes unless stated. Where the law requires, sales tax, value-added tax or similar tax is calculated and shown before you pay, and collected with your payment (Part B, B8).
22. Contact
TeacherTeacher LLC (New Mexico Business ID 0008138074), 1209 Mountain Road Pl NE, Ste R #13550, Albuquerque, NM 87110, USA. Email: info@teacherteacher.xyz. Phone: +1 231 709 9631. For copyright and other rights complaints see Part D, section D6.
PART B. PLANS, PAYMENT, RENEWAL AND REFUNDS
B1. Plans
We offer a free edition and paid plans for one, three or five registered computers. Each plan page shows what the plan includes, its price, its term and its renewal terms before you pay. Prices are per year unless the plan page says otherwise. The current plans are: one computer US$51.49 a year, three computers US$72.49 a year, five computers US$92.99 a year (teacherteacher.xyz/cam.html).
B2. Before you pay
Before you pay, we show the plan price, subscription term, renewal terms and cancellation instructions. You may cancel renewal using the cancellation method provided in your emails or account, or by contacting us as set out in these Terms. Cancellation stops future renewals; access continues until the end of the paid term unless applicable law or these Terms provide otherwise.
B3. Automatic renewal disclosure
Paid plans renew automatically for another term of the same length at the then-current price unless you cancel before the renewal date. At checkout, before you are charged, the price, the fact that the plan renews each year until cancelled, how to cancel and our refund rule are shown in clear words, and you agree to automatic renewal. A reminder is sent by email before each yearly renewal. A record of your agreement is kept and you receive a receipt.
B3a. Free trial and automatic conversion
Where we offer a free trial and you start one, the paid features are free for 14 days from the start. We take your payment details when you start. Unless you cancel before the end of the trial, your payment method is charged the price shown for the plan you chose, for one year, on the date shown, and again each year until you cancel. To avoid the first charge, cancel before the date shown. Cancelling stops all future charges, and you keep your access until the end of the trial or of the period you paid for. We email you a confirmation when the trial starts and a reminder 7 days before the first charge, with the date, the amount and the cancel link. There is one trial per person: a second trial is not available with the same payment method, computer or email. The grand-opening period (B10) needs no payment details and has no automatic charge.
B4. How to cancel
You can cancel from the link in every email about your plan, or by emailing info@teacherteacher.xyz. We confirm the cancellation by email. We do not require a phone call, a chat with a representative or a reason. Cancelling stops all future charges and renewals; your access continues until the end of the trial or of the term you already paid for. To avoid the next renewal charge, cancel before the renewal date shown in your emails.
B5. Refunds
You may ask for a full refund within 14 days of a purchase or of a yearly renewal, for any reason. After 14 days, fees are not refundable, except where the law of your place requires a refund (Part F), where section 13.2 requires one, or where we decide to give one. Please email info@teacherteacher.xyz, or use the link in your receipt, as soon as you can, with what you can show (for example the receipt, the date and a short description), if (a) a charge was a mistake or (b) your payment method was used without your permission. We will review it and do everything we reasonably can to put it right. (a) For a genuine mistake we cancel the subscription, refund what is due and keep your account. (b) If your payment method was used without your permission we refund, cancel, and close the account that was bought with it. Refunds are paid to the original payment method. Please write to us before you dispute a charge with your bank (section B7). Buyers in some regions have legal withdrawal rights that we do not limit (Part F). Full details: teacherteacher.xyz/refunds.html.
B5a. One person, one trial; closing accounts
The free trial and the grand-opening period are for one person on one computer. We keep the plans and the trial fair for everyone who pays. If we refund because your payment method was used without your permission, or we have reason to believe that someone is signing up again and again to get free or refunded service ("subscription hopping"), we may close the account and refuse a new trial, sign-up or purchase from the same email address, registered computer or payment method. We do not close an account because of a genuine mistake, or because someone uses a right the law gives them, except that the service for the account ends when the right is used. We keep a short record of why (Privacy Policy).
B6. Price and plan changes
We will tell you at least 30 days before a price or plan change that applies at your next renewal, and you may cancel before it applies. Upgrades during a term cost the flat difference between the plans and keep the same renewal date.
B7. Failed payments, chargebacks
If a payment fails we may retry it and tell you, and we may move you to the free edition if it is not resolved within 14 days. Please contact us before you dispute a charge with your bank so we can fix a problem or refund you. If you dispute a charge that we have already refunded, or without contacting us, we may suspend the plan until the dispute is resolved, and we may give your bank the records of your purchase and use of the licence. Section B5a explains when we close an account.
B8. Payments
Payments are processed by the payment provider named at checkout (for example a card processor or PayPal). If a reseller acts as Merchant of Record for an order, the checkout and your receipt say so; that reseller then processes the payment, issues the receipt, collects and pays any sales tax or VAT and handles billing and refunds for that order. Your payment details are collected and processed by the provider under its own terms and privacy notice; we do not receive or store your full card details. Earlier one-off purchases on our website (for example sentence-bank packages) may be paid through PayPal under its own terms.
B9. Specialty bundles
A specialty bundle is a one-time purchase for the rights of use described on its product page. Purchased files are stored on your computer and are not disabled solely because your subscription expires. Your use remains subject to the applicable licence and any disclosed third-party restrictions.
B10. Grand opening period
For a launch period ending on one calendar date that we announce on our website, teachers who register get the full paid plan for one registered computer per email address, free, with no payment details and no automatic charge. When it ends they may buy a plan or return to the free edition and use it indefinitely. Any free trial (B3a) is offered after this period.
PART C. ACCEPTABLE USE
C1. You will use the Cam lawfully and follow the rules of your school, your employer and the class apps you teach on.
C2. You may not use the Cam to: harass, threaten, defame, discriminate against, deceive or impersonate any person; show or share illegal, obscene or sexually explicit material; harm or endanger children, or show a child without the permissions the law requires; infringe another person's rights; collect personal information about others without their consent; spread malware or interfere with the Cam, our servers or any network; or mislead others about who you are.
C3. You may not use the Cam, its props, backgrounds, face filters or avatars to create a false or misleading picture of a real person or to suggest that a real person has endorsed something.
C4. You may not use the Cam for a use that its failure could make dangerous (section 9.2), or in breach of export and sanctions laws (section 20).
C5. We may remove material we supply, suspend a licence, or take other reasonable action if we reasonably believe that C1 to C4 have been broken. Where practical we will tell you first.
C6. Report a concern to info@teacherteacher.xyz.
C7. You may not use the Cam, its pictures or our name to campaign for, promote or oppose any political party, candidate, ideology or organization, or to suggest that we support one.
PART D. PICTURES, PROPS AND INTELLECTUAL PROPERTY
D1. What we own
We and our licensors own the Cam, its code, design, names, logos, look and feel, and the sample props and backgrounds. The names TeacherTeacher™, TeacherTeacher Cam™ and Teacher! Teacher!™, the TeacherTeacher boy mascot and our logos are our trademarks (used by TeacherTeacher LLC since September 2026); do not use them in a way that suggests we endorse you or that confuses them with other marks.
D2. Pictures, props, backgrounds and emoji
D2.1 What they are. The props, backgrounds and emoji pictures that come with the Cam are samples: examples of artwork to use on camera. They are complimentary library items: what your subscription pays for, and how we add, change or retire items, is in section 7.5.
D2.2 How they were made. From 2026-10-15 the props, backgrounds and other pictures in the Cam are created, corrected and replaced using ChatGPT (OpenAI) under a paid ChatGPT subscription. Pictures not yet corrected are earlier work: some drawn by our own program code with AI assistance (no third-party picture, typeface file or library), some generated with AI image tools including ChatGPT and Grok (SpaceXAI). Some older pictures were made with AI tools, and we have not been able to confirm from the files which tool made which picture. We review pictures for logos, trademarks, recognizable branded products and protected emblems, and we aim to include none.
D2.3 Terms of the AI tools (checked 2026-10-14; dated copies are kept).
- OpenAI Terms of Use (https://openai.com/policies/terms-of-use/, effective January 1, 2026): as between the user and OpenAI, the user owns the output, and OpenAI assigns to the user its rights in it. We use ChatGPT-made props, backgrounds and pictures under those terms and owe OpenAI no royalty for them. The terms do not require attribution; we may say that a picture was made with ChatGPT.
- xAI Terms of Service (https://x.ai/legal/terms, updated October 12, 2026) and Brand Guidelines (https://x.ai/legal/brand-guidelines): the user keeps ownership of the output, and the user must attribute Grok-generated images to the service. Wherever a Grok-generated background is shown or distributed we will display "Created with Grok".
- Each tool's terms may change and may differ on free and paid plans.
D2.4 What you may do. You may use a sample as supplied, inside the Cam, for your own teaching and presenting. You may not resell, redistribute or repackage the samples, or register any of them as a mark.
D2.5 What we do not promise. We do not guarantee that a sample is free of resemblance to another work.
D2.6 Questions and complaints. "If you have any question or concern, or believe that a mistake has been made, please email us at info@teacherteacher.xyz for prompt investigation." This is in addition to the notice-and-takedown process in D6.
D2.7 Historical figures. Some pictures show historical figures as cartoons. See D3, which the owner has decided to keep.
D2.8 Future protections. (a) *Grok:* the Cam does not include Grok-made backgrounds at this time. If we add any, we will first read and save Grok's terms and Brand Guidelines for that date, show "Created with Grok" wherever the picture is shown or distributed, and list it in this notice. (b) *ChatGPT:* all new and corrected props, backgrounds and pictures are made with our paid ChatGPT subscription; we rely on OpenAI's terms as in D2.3; if its terms change we will review the pictures made under the old terms. (c) *Any other tool:* the same steps before use. This note is a precaution; it does not promise that we will add pictures from any tool.
D3. Statement on historical figures
INTELLECTUAL PROPERTY & PUBLICITY RIGHTS DISCLAIMER
1. Public Domain & Historical Accuracy. PART E. DISPUTE RESOLUTION
E1. Talk to us first (required)
Before starting any claim, send a written notice of dispute to info@teacherteacher.xyz and by post to TeacherTeacher LLC, 1209 Mountain Road Pl NE, Ste R #13550, Albuquerque, NM 87110, USA, with your name, the email you used to buy, what happened, the amount you ask for, and what you want. We confirm receipt within 3 business days. For 60 days after we receive it, we will try in good faith to settle it informally, and on your request we will hold a video or phone call about it. A claim may not be filed in court (other than small claims) until this step is completed and the 60 days have passed.
E2. Courts and jury waiver
Subject to Part F, any dispute, claim or controversy about the Agreement or the Cam will be brought only in the state or federal courts located in Bernalillo County, New Mexico, and you and we consent to the personal jurisdiction of those courts and to venue there. To the fullest extent the law allows, both of us waive a trial by jury. Where the court allows it, we do not object to a hearing by video.
E3. Small claims and urgent relief
Either of us may bring an individual claim in a small-claims court that has jurisdiction. Either of us may ask a court for urgent relief to protect intellectual property or confidential information.
E4. No class, collective or representative actions
To the fullest extent the law allows, claims may be brought only in your or our individual capacity, and not as a plaintiff or member of a class, collective, consolidated or representative proceeding.
E5. Costs
Each of us bears our own lawyers' fees and costs unless the law or a court order gives a right to them.
E6. Time to bring a claim
To the extent the law allows, a claim must be started within one year after it arose, or it is barred.
E7. Survival and severability
This Part E survives the end of the Agreement. If any part of it is unenforceable, the rest is enforced as far as the law allows. There is no arbitration.
PART F. CONSUMER RIGHTS SCHEDULE
These terms apply in addition to the rest of the Agreement for people who buy as consumers (for purposes outside their trade, business or profession) and who live in a place whose law gives them rights that cannot be waived.
F1. Nothing in the Agreement removes or limits rights you have as a consumer under the mandatory law of the place where you live, and if a term of the Agreement conflicts with those rights, the law of your place controls for that term to the extent it must.
F2. European Union, United Kingdom and similar places. You may bring a claim in the courts of the place where you live. The court and class-waiver provisions of Part E apply only to the extent the law of your place allows them for consumers. Where the law of your place gives you a right to withdraw from a distance purchase within 14 days, the right applies, unless you gave your express consent to start the service early and acknowledged that the right may be lost, as set out in section B5. The statutory guarantees that goods and digital content are of satisfactory quality, as described, and fit for purpose are not excluded.
F3. Liability. The limits in sections 10 and 11 apply only as far as the law of your place allows. We do not limit liability for death, personal injury, fraud, or other matters that cannot lawfully be limited.
F4. Changes and renewal. Where the law of your place gives you extra rights to cancel or to a refund when we change the terms, or to be reminded before a renewal, those rights apply.
F5. Governing law for consumers. Part A section 19 applies together with mandatory consumer law of your place.
F6. Online dispute resolution. Where required, you can use the official online dispute resolution platform or the body that applies to you.
